1. Acceptance of Terms

By using Budget Splitter, you agree to be bound by these Terms. If you do not agree, do not use the app.

2. Description of Service

Budget Splitter is a mobile application for creating expense groups, recording shared expenses, splitting costs, calculating balances, and using AI-powered receipt scanning.

3. User Requirements

You must:

Be at least 13 years old (16 in the EU, or 13-16 with parental consent)
Have legal capacity to enter into binding agreements
Provide accurate information
Maintain account security

4. User Obligations

You agree NOT to:

Use the service for illegal purposes
Violate any laws
Transmit malicious code
Gain unauthorized access
Harass or harm other users
Reverse engineer the application

5. Intellectual Property

All content and functionality of Budget Splitter is owned by Mikhail Kosy. You retain rights to your data. By using the service, you grant us a limited license to use your data solely to provide the service.

6. AI Features

When using AI receipt scanning:

Receipt photos are sent to OpenAI for processing
Photos are not permanently stored by OpenAI
Accuracy is not guaranteed
You are responsible for verifying AI-extracted information

7. Privacy

Your use is governed by our Privacy Policy, incorporated by reference.

8. Financial Transactions

Budget Splitter is a tracking tool only. We do NOT process payments, transfer money, provide banking services, or guarantee payment of debts between users. You are responsible for verifying all amounts and settling debts.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

Service provided "AS IS" without warranties
We are not liable for indirect, incidental, special, consequential, or punitive damages
Total liability shall not exceed €50 (EU) or $50 (US), or amount paid in preceding 12 months, whichever is greater
We are not responsible for disputes between users

Some jurisdictions do not allow limitation of liability, so the above may not apply to you.

10. Indemnification

You agree to indemnify Mikhail Kosy from claims arising from your use of Budget Splitter, violation of these Terms, or violation of any rights of another.

11. Service Modifications

We reserve the right to modify, suspend, or discontinue any feature at any time. We are not liable for service interruptions.

12. Third-Party Services

Budget Splitter uses AWS Cognito (authentication) and OpenAI (AI processing). Your use is subject to their terms. We are not responsible for third-party services.

13. Dispute Resolution

Governing Law

EU Users: Laws of Poland and European Union
US Users: Laws of your state of residence
Other: Applicable local laws

Jurisdiction

EU Users: Courts of Poland
US Users: Federal or state courts in your state of residence
Other: Appropriate courts of your jurisdiction

Informal Resolution

14. Severability

If any provision is invalid or unenforceable, it shall be modified or severed. Remaining provisions remain in effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Mikhail Kosy.

17. Changes to Terms

We may update these Terms. We will notify you of material changes by posting updated Terms and updating the "Last updated" date. Continued use after changes constitutes acceptance.

18. Consumer Rights

EU users have certain consumer rights that cannot be excluded, including right to withdraw (if applicable), right to clear information, and data access rights.

US users retain rights under applicable state and federal consumer protection laws.
